AND DISCUSS THE POINTS OF A SETTLEMENT PROPOSAL FOR THE STEHLI MATTER THAT INVOLVES DARRYL BAUMSTEIN, SONYA BAUMSTEIN AND GARY STEHLI IN THIS LITIGATION. MADAM CITY ATTORNEY MAYOR AND COMMISSIONERS, WE HAVE REACHED A COMMITMENT AND A WILLINGNESS BY ONE OF THE TWO SETS OF PROPERTY OWNERS IN THIS EMINENT DOMAIN LAWSUIT BASED ON RESOLUTION 2025-07, IN SUPPORT OF THE LAKE MARIA SANCHEZ SEAWALL PROJECT. WE ARE TALKING ABOUT WHAT'S CALLED THE STEHLI PARCEL S T E H L I FOLLOWING A PREVIOUS ADVICE AND DIRECTION WE HAVE ENTERED INTO GOOD FAITH NEGOTIATIONS WITH THIS GROUP OF PROPERTY OWNERS FOR THEIR VOLUNTARY CONVEYANCE OF ALL OF THE EASEMENTS THAT THE CITY OF SAINT AUGUSTINE IS SEEKING ACROSS THAT PARCEL. IN THE LAWSUIT AND THE PROPOSED EASEMENT PAYMENT AMOUNT IS $450,000. THAT IS EXCLUSIVE OF STATUTORY ATTORNEY'S FEES. SO A STATUTORY ATTORNEY'S FEE WOULD BE CALCULATED ON TOP OF THAT, ACCORDING TO CHAPTER 73 OF THE FLORIDA STATUTES. AND WE ESTIMATE THAT THE TOTAL ALL IN COST ATTORNEY'S FEES INCLUDED WOULD BE AT OR LESS $550,000 TO OBTAIN THE EASEMENTS ON THIS PARCEL. AND IT IS YOUR COUNCIL'S RECOMMENDATION AT THIS TIME THAT THIS IS A GOOD SETTLEMENT TO MAKE FOR THIS PARTICULAR PROJECT. AND THE ELIMINATION OF ONE HALF OF THE EMINENT DOMAIN LAWSUIT AT THIS TIME. SO WE'RE LOOKING TO THE COMMISSION FOR A MOTION TO APPROVE THOSE SETTLEMENT TERMS. AND TO AUTHORIZE MR. BIRCHIM TO EXECUTE THE FINAL SETTLEMENT DOCUMENTS. OKAY. SO I'LL ENTERTAIN A MOTION TO APPROVE THE WHAT MR. CAVENDISH STATED. AND THEN AUTHORIZATION. THAT MOTION NEEDS TO INCLUDE AUTHORIZATION FOR MR. BIRCHIM TO EXECUTE. OKAY, I'LL MAKE A MOTION.
